TERMS OF SERVICE

GENERAL

• The artist hereby sells or transfers the commission to the Client at the agreed value written in the commission agreement prior to the start of work.
• By ordering a commission the Client agrees to these Terms of Service.
• The Artist does not take reservations.
• Deadlines range from one week to 2 months. Commission can be executed in a short time for an additional fee.

PAYMENT

• Full payments of the commission must be made prior to the start of work.
• Payment method is determined and agreed upon prior to the start of work. Payments will be made through PayPal’s via invoice.
• Prices are in Euro, unless specified otherwise.

COMMISSION DESCRIPTION

• The client must provide and specify the content of their commission request. Non-visual references may result in additional fees or be declined.

CANCELLATION & REFUND POLICY

• The client may cancel the commission request at any time, however, refund percentages will be determined by the stage of the commission by the artist. Stage 1: Sketch – 50% of the payment is non-refundable. Stage 2: Color – 75% of the payment is non-refundable. Stage 3: Completed Artwork – 100% of the payment is non-refundable.
• In case of Emergency commissions there is no refund option.
• The artist has the right to cancel a commission request due to rude/inappropriate behavior, poor communication, or breach of these Terms of Services. In the event of cancellation from the artist, a refund may be requested, determined by the stage of the commission by the artist as mentioned above.

REVISIONS

• The Artist will show the process at sketch and color stages for approval/changes before moving onto the next part. After the Artist has received approval, there will be no new revisions/additions.
• Big changes (changing pose/geometry/color palette) might require additional fees.
• Finished artwork will not be revised.

ARTIST’S RIGHTS

• Decline any commission request without needing to explain the reason.
• Work on commission in public art streams and post Work in Progress on social media (Bsky, Patreon etc.), unless specified otherwise.
• Cancel a commission request due to rude/inappropriate behavior, poor communication, or a breach of these Terms of Services.
• Retain all rights to the commission, which includes but not limited to: distribution, reproduction, use of the commission for artist promotion (e.g. posting on social media).

CLIENT’S RIGHTS

• Request a deadline for the commission.
• Request a preview of the commission at any time during the creation process.
• Request minor changes to the commission during sketch and color stages, but not during the completed stage, unless the client is willing to pay for additional charges.
• Cancel a commission and request a refund at any time, however, the refund percentage will be determined by the stage of the commission by the artist. Stage 1: Sketch – 50% of the payment is non-refundable. Stage 2: Color – 75% of the payment is non-refundable. Stage 3: Completed Artwork – 100% of the payment is non-refundable.
• The Client buys a private commission intended for private use only, which includes: icons, profile images (such as for roleplaying), forum signatures, additions to personal galleries, printouts for personal use (such as a con badge), and other simple online musings. Limited alterations of the artwork, such as cropping or adding text, are permitted as long as it’s for personal use.
• Display the commission as long as the artist’s name is prominently displayed along with a link to either their socials or website of the artist.
• Clients shall not reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate work, including without limitation, technologies that are capable of generating works in the same style or genre as the Work. Nor shall the Client sublicense others to reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate work.
• The Client may not use or alter the commissioned artwork for the purpose of monetary gain.
